Terms of Use

This agreement is with us, not Apple

These Terms are concluded between you and Raman Studios only, and not with Apple. Apple is not responsible for the App or its content. Your use of the App must also comply with the Apple Media Services Terms and the Usage Rules set out therein.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms. You may not copy, redistribute, rent, lease, sublicense, reverse-engineer, decompile, or resell the App except as expressly permitted by these Terms or applicable law.

What the App does

The App lets you edit the content of the website Raman Studios built for you — text, links, button labels, and images — and publish those changes to your live site, directly from your phone. You may also submit change or animation requests. Editing and publishing require an active Everything subscription.

Subscription, billing, and renewal

The Everything subscription is an auto-renewable subscription that unlocks editing and publishing. It costs US$14.99 per month (or the equivalent in your local currency, as shown in the App at the time of purchase).

Payment is charged to your Apple Account at confirmation of purchase. The subscription automatically renews for the same period and price unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time in your App Store account settings; cancelling stops future renewals but does not retroactively refund the current period. If we change the price, Apple will notify you and, where required, ask for your consent before the change takes effect.

Your content and your website

You retain ownership of the text, images, and other content you create or upload through the App. You grant us the limited license needed to store, process, and display that content for the purpose of saving your edits and publishing them to your website. You are responsible for the content you publish and represent that you have all rights necessary to publish it and that it does not violate any law or any third party's rights.

Acceptable use

You agree not to use the App to publish or transmit content that is unlawful, infringing, defamatory, or harmful, and not to interfere with, attack, probe, or attempt to gain unauthorized access to the App, our systems, or other users' data. We may suspend access that we reasonably believe violates these Terms.

Purchases and refunds

The App and the subscription are sold through the Apple App Store. All purchases, billing, and refunds are handled by Apple under the Apple Media Services Terms. Refund requests must be made to Apple — we cannot issue App Store refunds directly.

Maintenance and support

Raman Studios is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish maintenance or support services. For help, email ramsmov@gmail.com.

No warranty

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.

Limitation of liability

To the maximum extent permitted by law, Raman Studios shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data or revenue, arising out of or related to your use of the App. Our total liability for any claim shall not exceed the amount you paid us through the App in the twelve months before the claim arose.

Third-party services and Apple as beneficiary

The App relies on third-party services to operate, including Apple (for sign-in and purchases) and Google Firebase (for authentication, data storage, and publishing). Your use of those services may be subject to their own terms. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and that, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

Legal compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Termination

You may stop using the App and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms. The sections covering content ownership, warranty disclaimers, limitation of liability, and governing law survive termination.

Intellectual property

The App, including its name, design, and code, is owned by Raman Studios and is protected by applicable intellectual-property laws. These Terms grant you no rights in our trademarks or branding.

Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page with an updated date. Continued use of the App after changes means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
